HIIT PILATES Phuket Retreat Booking Terms
Five-night fitness and wellness retreat | 8-13 February 2027
1. Parties and acceptance
These Terms and Conditions (Terms) form a contract between HIIT Pilates Pty Ltd ABN 35 637292 187 of Tenancy 15, 61-71 Mentmore Avenue, Rosebery NSW 2018 (Organiser, we, us or our) and each person named in a booking (Guest, you or your). By completing payment, ticking the acceptance box, or participating in the Retreat, you confirm that you have read, understood and agree to these Terms. The person making a shared-room booking confirms they are authorised to accept these Terms on behalf of both named guests; each adult guest must also separately complete the required health and participation forms.
2. Retreat details
Retreat: Villa Beyond Phuket Retreat
Dates: Late arrival Monday 8 February 2027 to checkout by 3:00 pm Saturday 13 February 2027
Location: Villa Beyond, Kamala, Phuket, Thailand
Capacity: Seven rooms only; places are confirmed in order of cleared full payment
Program: Pilates, strength conditioning, Pilates circuits, group bootcamp, meals, free time and optional local activities.
The published itinerary is indicative. We may make reasonable changes to instructors, class order, meals, activities or timing for safety, weather, operational or supplier reasons, while preserving the overall nature and value of the Retreat where reasonably possible.
3. Prices and payment
Single occupancy: king bed + ensuite (standard price $2,900 AUD / flash-sale discount $200 AUD)
Shared room: one king bed +ensuite for two guests (standard price $4,999 AUD / flash-sale discount $400 AUD)
Full upfront payment is required at purchase. A booking is not confirmed until payment has cleared and we issue confirmation.
Prices are in Australian dollars (AUD) and include GST if applicable. Any card, platform or currency-conversion fee disclosed before payment is additional.
The 24-hour flash sale runs from 12:00 am to 11:59 pm on 2 September 2026, Sydney time (AEST). The discount applies only to eligible bookings fully paid during that period, cannot be backdated, transferred or combined with another offer, and ends earlier if sold out.
Only seven rooms are available. Display of availability does not reserve a room; simultaneous purchases may occur, and the first seven successfully paid bookings receive priority. If we accept payment after capacity is reached, we will promptly refund that payment in full.
4. What is and is not included
Included
Five nights’ accommodation in the room category purchased. Airport transfers between Phuket International Airport and the villa at the designated group transfer times notified by us. Meals prepared at the house as described in the final itinerary. Scheduled group fitness sessions and included retreat programming.
Not included
Airfares and airline fees. Travel insurance, passports, visas, vaccinations, medical expenses and personal expenses. Optional tours, spa treatments, alcoholic beverages, meals or transport outside the included program unless expressly stated in writing. Private or out-of-hours airport transfers caused by a guest’s flight choice, change, delay or missed connection, unless we agree otherwise in writing.
5. Guest cancellation and refunds
Cancellation must be sent in writing to hello@hiitpilatesstudio.com and is effective when received by us. If we receive your cancellation before 11:59 pm Sydney time on 30 November 2026, we will refund 50% of the amount actually paid for the booking. If we receive your cancellation after 11:59 pm Sydney time on 30 November 2026, no refund is payable for change of mind, illness, injury, work or family commitments, travel disruption, failure to obtain travel documents, or any other guest-related reason. Flash-sale bookings follow the same cancellation percentages, calculated on the discounted amount actually paid.
No refund is payable for late arrival, early departure, missed sessions or unused inclusions. We strongly recommend comprehensive travel insurance that covers cancellation and medical treatment.
6. Transfers and substitutions
You may request to transfer a booking to another eligible adult by 31 January 2027, subject to our written approval, completion of all health and booking forms, supplier restrictions and payment of any reasonable documented costs. Room categories and sale discounts cannot otherwise be exchanged for cash or credit. We may refuse a substitution on reasonable health, safety, legal, accommodation or operational grounds.
7. Cancellation or changes by us
If we cancel the entire Retreat before it begins, we will offer the remedy required by applicable law. Depending on the circumstances, this may include a replacement retreat, credit or refund of amounts paid to us for services not supplied. We are not responsible for airfares or other third- party costs except to the extent required by law, so guests should book flexible travel and hold suitable insurance. If circumstances outside our reasonable control prevent, delay or materially affect delivery - including severe weather, natural disaster, epidemic, government restriction, civil disturbance, transport disruption, villa unavailability or supplier failure - we will act reasonably and communicate available options. Your rights will depend on these Terms and applicable law. Nothing here removes any non-excludable Australian Consumer Law rights.
8. Eligibility and health screening
Guests must be at least 18 years old unless we expressly agree otherwise in writing. Before participating, each guest must complete our health questionnaire and an
evidence-based adult pre-exercise screening process. We may request medical clearance where screening responses, pregnancy, recent surgery, injury, illness, medication or another condition indicates increased risk. You must give complete and accurate information about relevant medical conditions, injuries, allergies, dietary requirements, medications, pregnancy, disability and emergency contacts, and promptly tell us if anything changes. The Retreat is not medical care, physiotherapy, rehabilitation or personalised medical advice. You are responsible for consulting an appropriate health professional if you are unsure whether participation or overseas travel is suitable.
We may modify or decline your participation in a particular activity where reasonably necessary for safety. This does not automatically entitle you to a refund, except where required by law.
9. Exercise and recreational risk warning
WARNING – PHYSICAL ACTIVITY INVOLVES RISK
The Retreat includes Pilates, strength and conditioning, circuit training, bootcamp, stretching, outdoor exercise, stairs, pool areas, walking and optional excursions. Risks may include overexertion, falls, slips, collisions, equipment failure, heat illness, dehydration, sun exposure, muscle soreness, sprains, fractures, aggravation of an existing condition, serious injury and, in rare cases, death. You acknowledge that these activities have inherent and obvious risks and that conditions in Thailand may differ from Australia. You voluntarily choose to participate and accept risks that cannot be eliminated through reasonable care. You must exercise within your capabilities, use equipment only as directed, stop if you feel pain, dizziness, faintness, unusual shortness of breath or other concerning symptoms, and immediately notify an instructor.
To the maximum extent permitted by law, our liability for harm arising from recreational activities may be limited by applicable legislation, including the Civil Liability Act 2002 (NSW) and the Competition and Consumer Act 2010 (Cth). This clause does not exclude liability or rights where exclusion is prohibited, including liability that cannot lawfully be excluded for negligence or breach of a non-excludable consumer guarantee. A lawyer should tailor the final risk warning to the Organiser, activities, insurers and contracting process.
10. Safety rules and participant conduct
Follow all reasonable instructions from instructors, villa staff, transport providers and activity operators, including class modifications, hydration breaks and evacuation
procedures. Wear suitable footwear and clothing, use sun protection, remain hydrated and avoid training under the influence of alcohol, illicit drugs or impairing medication. Do not participate when unwell, injured or experiencing symptoms that may endanger you or others. Tell an instructor before class if you need a modification. Respect other guests, staff, the villa, local laws and Thai customs. Harassment, violence, unsafe conduct, illegal drug use, serious intoxication or deliberate property damage is not permitted.
We may direct a guest to stop an activity or leave the Retreat for serious or repeated unsafe, unlawful or disruptive conduct. Subject to applicable law, no refund is payable where removal results from the guest’s breach, and the guest is responsible for resulting transport or damage costs.
11. Emergency care
In an emergency, you authorise us to contact emergency services, your emergency contact and available medical providers, and to arrange urgent treatment or transport where you cannot consent. We will act reasonably but cannot guarantee the availability or standard of third-party medical services. You are responsible for medical, ambulance, evacuation and repatriation costs, except to the extent caused by our breach of law. You must hold travel insurance with adequate overseas medical and evacuation cover and provide policy details if requested.
12. Food, allergies and dietary requirements
Tell us in writing of all food allergies and dietary requirements by 31 January 2026. The chef will use reasonable care, but the villa kitchen may handle common allergens and we cannot guarantee an allergen-free environment. Guests with a severe allergy must bring prescribed medication, disclose their action plan and understand the limits of an onsite domestic-style kitchen. If we cannot safely accommodate a requirement, we will discuss reasonable alternatives before the Retreat where practicable.
13. Travel document and insurance
You are responsible for valid passports, visas, entry and health requirements, vaccinations, airline bookings and arriving at the designated transfer point on time. Government and airline requirements can change. You must obtain comprehensive travel insurance promptly after booking, including cancellation, overseas medical care, emergency evacuation, personal liability, baggage and activity cover suitable for the planned sessions and any optional excursions.
14. Accommodation, sharing and property
Room allocations are based on the category purchased. A shared booking is for two named guests sharing one king bed and ensuite; we do not provide roommate matching
unless expressly agreed. Guests must comply with villa rules, security requirements and reasonable check-in/check-out instructions. Check-out is by 3:00 pm on 13 February 2027.
You are responsible for loss or damage you intentionally or negligently cause to the villa, equipment or third-party property, fair wear and tear excepted. We may recover reasonable documented repair or replacement costs. Personal belongings remain your responsibility. Use any available safe and do not leave valuables unattended.
15. Optional third-party activities
Optional tours, spa services, beach clubs, restaurants and other third-party services are separate contracts with those providers unless we expressly state otherwise. Their terms, waivers, insurance and cancellation policies may apply. We are not responsible for independent providers except to the extent required by law or where we have failed to exercise reasonable care in selecting or arranging them.
16. Photos and marketing
We will obtain your separate, voluntary consent before using identifiable photos or video of you for marketing. You may decline without affecting your booking. You may withdraw consent for future use by contacting hello@hiitpilatesstudio.com, although withdrawal cannot undo material already lawfully published. Guests must respect others’ privacy when posting personal images or information.
17. Privacy and health information
We collect personal and sensitive information, including health, dietary and emergency information, to administer the booking and manage safety. We will collect only what is reasonably necessary, restrict access, use it for the stated purposes, disclose it where reasonably necessary to instructors, villa staff, emergency or medical providers, insurers and service providers, and protect and retain it in accordance with applicable privacy law and our
Privacy Policy at [https://hiitpilatesstudio.com/privacy]. Where the Privacy Act 1988 (Cth) and Australian Privacy Principles apply, we will comply with them. Health information may also be disclosed where authorised or required by law or necessary to lessen or prevent a serious threat, as permitted by law.
18. Liability and consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to those rights and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss caused by your breach or failure to follow instructions, or acts of independent third parties outside our reasonable control. Any permitted limitation must be read down to the extent necessary to be lawful.
19. Complaints and disputes
Please raise concerns promptly with the retreat host so we have a reasonable opportunity to address them. Formal complaints should be sent to hello@hiitpilatesstudio.com with relevant details. The parties will first try in good faith to resolve a dispute directly. This does not prevent
either party from seeking urgent relief, contacting NSW Fair Trading or the ACCC, or exercising any statutory right.
20. General
These Terms and the booking confirmation constitute the agreement. If there is an inconsistency, any non-excludable law prevails, followed by the booking confirmation
and then these Terms. A waiver must be in writing. If any provision is invalid or unenforceable, it is read down or severed without affecting the remainder. You may not assign your booking except under clause 6. We may use qualified staff and service providers to deliver the Retreat. These Terms are governed by the laws of New South Wales, Australia. Subject to non- excludable rights, the parties submit to the courts of New South Wales.
21. Customer Acknowledgment
I have read and agree to the Retreat Terms and Conditions and Privacy Policy. I understand that full payment is required now; the guest-cancellation refund is 50% only if written cancellation is received before 11:59 pm Sydney time on 30 November 2026, and otherwise no change-of-mind refund applies; airfares and travel insurance are not included; and physical activity involves the risks described in the risk warning. I confirm the guest details are accurate, and I will complete all required health-screening forms.
